We do not: Diagnose medical or mental health conditions, Provide treatment plans or therapeutic interventions, Offer crisis support or emergency services , Replace professional medical or mental health care. If you are experiencing a mental health crisis, suicidal thoughts, or are in immediate danger, please seek help from a licensed professional or contact emergency services immediately. 5. Privacy Policy Your privacy is important to us. Our collection, use, and disclosure of your information is governed by our Privacy Policy, which is incorporated by reference into these Terms. You acknowledge and agree that: - AI-generated content is meant to support emotional insight, not replace professional care - We make no guarantees about the accuracy, completeness, or effectiveness of AI-generated content - You should always use your own judgment when considering AI-generated suggestions - AI responses are based on patterns and may not always be appropriate for your specific situation
8. Intellectual Property
8.1 Our Content All content on Head Change—including text, design, software, AI models, and generated content is the property of Head Change AI LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.
8.2 Data Handling Head Change is designed with privacy by default. We do not store the full details of your conversations. We may retain minimal, non-identifying information (such as card selections and session keywords) to help improve the Service.
9. Subscriptions and Payments
9.1 Free and Paid Services We may offer both free and paid versions of our Service. Paid subscriptions will be clearly identified with pricing and terms.
9.2 Automatic Renewal Recurring subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

12.2 Liability Cap OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) FIFTY DOLLARS ($50), OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14.3 No Class Actions YOU AND HEAD CHANGE AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.
14.4 Arbitration Procedures - Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules - The arbitration will take place in California or via video conference - Each party pays their own fees, but if arbitrator finds bad faith, that party pays all fees - Arbitrator's decision is final and binding
14.5 Opt-Out Right You may opt out of arbitration by emailing clarity@headchange.ai within 30 days of first using the Service with "Arbitration Opt-Out" in subject line.
14.6 Severability If any part of this arbitration agreement is found unenforceable, that part will be severed and the rest remains in effect. However, if the prohibition on class actions is found invalid, then any class, collective, or representative claims must be brought in court, not arbitration. All individual claims remain subject to arbitration.
15. Governing Law and Venue - These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration will be resolved in the state or federal courts located in California, and you consent to the jurisdiction of such courts. **International Users:** If you are located in a jurisdiction that prohibits certain provisions of these Terms (such as arbitration clauses or California governing law) or provides mandatory consumer protections that cannot be waived, then those local laws will apply to the extent required, and we may modify these Terms accordingly for users in your jurisdiction.
